Privacy Policy

Empower Agile is established in Chile, so we process personal data under Chile's Law No. 21.719 on the protection of personal data. Where visitors are in the European Union or the United Kingdom, the GDPR may apply in addition. Both point to the same commitments, and we apply them to everyone rather than switching behaviour by country.
1. Who is responsible
The controller of your personal data is Empower Agile, established in Chile. For anything concerning your personal data, write to [email protected].
2. What we process, and why

We do not process special category data, we do not profile you in a way that produces legal effects, we make no automated decisions about you, and we do not sell your data.
3. How long we keep it
- Contact form messages: up to 24 months after our last exchange, unless the enquiry becomes a commercial relationship, in which case the applicable accounting and tax retention periods take over.
- Analytics and session recording data: according to each provider's own retention periods, and in any case only until you withdraw consent.
- Your cookie choice: 6 months, after which we ask again.
4. Who we share it with
We use only the following providers, acting as processors on our behalf:
- Cloudflare — site hosting, form protection (Turnstile), and delivery of your message to our inbox. That delivery is handled by an Empower Agile application running on Cloudflare's infrastructure: no external email provider is involved, but the data does pass through Cloudflare's servers.
- Google — analytics, only if you allow it.
- Microsoft — session recording via Clarity, only if you allow it.
5. International transfers
These providers process data on servers outside Chile, mainly in the United States and the European Union. Those transfers rely on the contractual safeguards those providers offer, as Law No. 21.719 requires. Write to the address in section 1 if you would like details of the safeguards that apply.
6. Your rights
You have the following rights over your personal data:
- Access — to know what data we hold about you and how we use it.
- Rectification — to correct data that is wrong, outdated or incomplete.
- Erasure — to have your data deleted where that applies.
- Objection — to object to a particular processing activity.
- Blocking — to have processing suspended while a request is resolved.
- Portability — to receive your data in a structured, commonly used format, or have it transferred to another controller.
To exercise them, write to [email protected] saying which right you want to exercise. This is free of charge. We will reply within the applicable legal period, which as a general rule is 30 business days, extendable once where the request justifies it. Blocking requests are resolved far sooner, within 2 business days.
If you are unhappy with our response, or we do not reply in time, you can complain to the Chilean Personal Data Protection Agency. Visitors in the EU or UK may also complain to their local supervisory authority.

We apply reasonable technical and organisational measures, including encryption in transit over HTTPS and restricted access to the mailbox that receives form messages. If a security breach occurs that poses a risk to your rights, we will notify the Personal Data Protection Agency and, where required, you, without undue delay.
9. Children
This site is aimed at adults enquiring about professional services and software licensing. We do not knowingly collect data from children.
10. Changes to this policy
If we change this policy materially we will update the date above, and where the change affects the purposes you allowed, we will ask for your consent again through the cookie notice.
